1. Acceptance of Terms

By accessing or using Wordsmiths (the "Service"), operated by Second Wind Studios LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Wordsmiths is a multiplayer word game that allows users to play in various game modes including turn-based and real-time battles. The Service may be accessed as a guest or with a registered account via Google Sign-In.

3. Accounts

  • You may sign in using Google to create an account
  • You are responsible for maintaining the security of your account
  • You must provide accurate information and keep it up to date
  • You may not create multiple accounts to circumvent bans or manipulate rankings
  • We reserve the right to suspend or terminate accounts at our discretion

4. User Conduct

You agree not to:

  • Use offensive, hateful, or inappropriate display names
  • Harass, abuse, or threaten other players
  • Use bots, scripts, or automated tools to play the game
  • Exploit bugs, glitches, or vulnerabilities in the Service
  • Attempt to manipulate rankings, statistics, or leaderboards
  • Interfere with or disrupt the Service or its servers
  • Reverse engineer, decompile, or disassemble any part of the Service

5. In-Game Purchases

The Service offers virtual items, cosmetics, in-game currency ("Gold"), and other digital content for purchase using real money.

  • All purchases are final and non-refundable unless required by applicable law
  • Virtual items and in-game currency have no real-world monetary value and cannot be transferred, traded, or exchanged outside the Service
  • Prices are displayed in USD and may change at any time without prior notice
  • Promotional offers (such as first-purchase bonuses) are subject to change or removal at our discretion
  • We reserve the right to modify, limit, or remove virtual items or currency at any time
  • In the event of account termination for violation of these Terms, you forfeit all purchased virtual items and currency with no right to a refund

6. Payment Processing

Payments are processed by Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's End User Terms. We do not store your credit card information. All payment data is handled securely by Stripe in accordance with PCI DSS standards.

If you believe a transaction was made in error or without your authorization, contact us at admin@secondwindstudios.io as soon as possible.

7. Intellectual Property

All content, design, code, graphics, and game mechanics of Wordsmiths are the property of Second Wind Studios LLC. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Second Wind Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or interruption of service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page when changes are made.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
